Meaning of Terms in these General Terms and Conditions

Buyer – any person who, after reviewing and selecting a product or service, has provided their data, ordered, and paid for the product or service.

Payment for the ordered product is made exclusively in cash upon delivery.

If the user refuses to accept the ordered product or refuses to pay the full purchase price and any delivery costs upon delivery, the Seller has the right to withdraw from the contract.

If the user fails to specify the delivery date, the Seller has the right to deliver the ordered product at any time.
If the user refuses to accept the ordered product or refuses to pay the full purchase price and any delivery costs upon delivery, the Seller has the right to withdraw from the contract.
The Seller is not responsible for any delay in delivery or failure to deliver the product due to incorrect or incomplete delivery information provided by the user.
The Seller is not responsible for any delay in delivery or failure to deliver the product due to force majeure, such as natural disasters, wars, strikes, and similar events that are beyond the control of the Seller.
The Seller will make every effort to deliver the ordered product within the agreed deadline.

In the event of a delay in delivery or failure to deliver the product, the Seller will inform the user as soon as possible and agree on a new delivery date.

The user has the right to cancel the order within 14 days from the date of receipt of the product.

The Seller is not responsible for any damage to the product that occurs during the return shipment.

Delivery
Delivery Costs
The delivery cost for all orders purchased on www.franjashop.com online store is 30.00 kuna.
Products that are paid according to the delivered offer will be delivered to the Buyer within 1-3 working days (except for islands, depending on the ferry schedule and the Dubrovnik region).
If you decide to make a purchase, you can choose delivery or personal pickup.
The goods can be collected at our store, located at Vlaška 62, during business hours.
The delivery of purchased goods is carried out by the Seller through the engagement of a specialized delivery company.
All deliveries are made through the transportation company OVERSEAS TRADE Co. which provides transportation services.
Products will be appropriately protected during packaging to ensure they are delivered undamaged through normal handling of packages during transportation.
The Buyer is obliged to check for any damage when receiving the product and report them immediately during the acceptance process to the delivery person who delivered the goods or refuse to accept the shipment with visible external damages that could affect the correctness of the purchased products.
The Buyer is also required to sign the delivery note when receiving the goods, which the delivery service will consider as confirmation of acceptance.
If the Buyer receives a product different from the one they ordered and purchased, the Buyer has the right to a replacement or delivery of the actually ordered product. If that is not possible, the Buyer has the right to a refund of the paid product price, delivery cost, and the cost of returning the product, and is obliged to return the incorrectly delivered product.
In the event that the Seller is unable to deliver the purchased product within 1-3 working days from the day of payment, the Seller is obliged to inform the Buyer to arrange a new delivery date.
In this case, the Buyer has the right to terminate the contract.
With the purchased product, the Buyer will receive an invoice, a receipt of receipt of the shipment that they are obliged to sign, and any other required documents accompanying the product (user manual, warranty card, etc.).
By signing the shipment receipt, the Buyer confirms that the product has been received without any visible external damages.
The goods are insured against loss during delivery.
Delivery prices are displayed on www.franjashop.com with included VAT.
Order Status
During the processing of the shipment, the Buyer will receive an email notification about the status of their shipment.
Returns
Before concluding the Contract, we recommend that the User review the Terms of Use of www.franjashop.com, which are listed in the drop-down menu under ‘Support’ (notice from Article 57, paragraph 1 of the Consumer Protection Act (Official Gazette, No. 41/2014), as well as the terms regarding the User’s right to unilaterally terminate the Contract with a termination form from Article 61, paragraphs 1 and 2 of the Consumer Protection Act.)
In accordance with Article 77, paragraph 1 of the Consumer Protection Act, the User has the right to unilaterally terminate the Contract within 14 (fourteen) days from the delivery of the goods to the possession of the Buyer, without stating a reason.
The User does not have the right to unilaterally terminate the Contract if the service that is the subject of the Contract has been fully performed, and its performance began with the explicit prior consent of the User and with their confirmation that they were aware that they would lose the right to unilaterally terminate the Contract if the service was fully performed.
In accordance with Article 77, paragraph 5 of the Consumer Protection Act, the User is responsible for any reduction in the value of the goods that results from their handling of the goods, except for handling that was necessary to determine the nature, characteristics, and functionality of the goods.
If the purchased product is returned to the Seller for any reason, it must be in its original packaging and with the label, the accompanying content, and the receipt, instructions for use, and warranty card. FRANJA TRGOVAČKI OBRT, owned by Jaki Franja, has the right to determine the conditions for the return of the goods – i.e., the percentage reduction of the refund amount to the Buyer due to a reduction in the value of the product.
In this case, the User/Consumer bears the cost of returning the goods.
Right to Return
Defects for which the seller is not liable
The Seller is not responsible for defects in the product if they were known to the Buyer at the time of concluding the Contract or could not have remained unknown to them.
In general, it is considered that the defects that a diligent person with average knowledge and experience in the same profession and field as the Buyer could easily notice during a routine examination of the item could not have remained unknown to the Buyer.
The provision of Paragraph 2 of this Article does not apply to contracts concluded by a natural person as the Buyer outside their economic or professional activity with a natural or legal person who, as the Seller, operates within the scope of their economic or professional activity (consumer contract).
The Seller is liable for defects that the Buyer could easily notice if they declared that the item had no defects or had certain characteristics or qualities that it did not have in reality.
Inspection of Items and Visible Defects
The Buyer is obliged to inspect the received item (purchased and delivered goods) in the usual manner or to provide it for inspection as soon as it is possible according to the regular course of things and to notify the Seller of any visible defects within 8 (eight) days, and in the case of a commercial contract, without delay; otherwise, they lose the right that belongs to them on that basis.
If the inspection is carried out in the presence of both parties, the Buyer is obliged to notify the Seller of their objections due to visible defects immediately, otherwise they lose the right that would otherwise belong to them on that basis.
If the Buyer has shipped the item (purchased and delivered goods) further without transshipment and in its original packaging, and the Seller was aware of or should have been aware of the possibility of such further shipment when concluding the contract, the inspection of the item from Paragraph 1 of this Article may be postponed until it arrives at its new destination. In this case, the Buyer is obliged to notify the Seller of the defects as soon as they could have learned about them from their clients according to the regular course of things.
In consumer contracts, the consumer as the Buyer is not obliged to inspect the item or provide it for inspection, but is obliged to inform the Seller of the existence of visible defects within two months from the day they discovered the defect.
Hidden Defects
If it is found after the receipt of the item by the Buyer that the item has a defect that could not be discovered by a regular examination when taking possession, the Buyer is obliged, under the threat of losing their rights, to notify the Seller of the established defect within 2 (two) months from the day they discovered the defect, and in the case of a commercial contract, without delay.
The Seller is not liable for defects that become apparent after 2 (two) years from the delivery of the item, and in the case of a commercial contract, 6 (six) months.
The deadlines from Paragraph 2 of this Article can be extended by agreement.
Unilateral Termination of the Contract
In order for the User to exercise the right to unilaterally terminate the Contract, they must inform FRANJA TRGOVAČKI OBRT, owned by Jaki Franja, about their decision to unilaterally terminate the Contract by an explicit statement (e.g., a letter sent by mail or e-mail) before the expiration of the withdrawal period or by using the withdrawal form from Article 61, paragraphs 1 and 2 of the Consumer Protection Act.
The User can also use the form of unilateral termination of the Contract or any other unambiguous statement sent electronically and downloaded from the website www.franjashop.com, but FRANJA TRGOVAČKI OBRT, owned by Jaki Franja, will immediately send the User an acknowledgment of receipt of the notification of unilateral termination of the Contract by e-mail.
To meet the withdrawal deadline, it is sufficient for the User to send their notice of exercising the right to unilaterally terminate the Contract before the withdrawal period has expired.
If the User unilaterally terminates the Contract, the Seller will refund to the User all payments received, including delivery costs, without delay, and no later than 14 (fourteen) days from the day the Seller receives the User’s decision to unilaterally terminate the Contract.
The Seller is not obliged to refund the payment to the User before they receive the returned goods or until the User provides proof that they have sent the goods back to the Seller, unless the Seller offers to take over the goods themselves.
The Seller is not obliged to refund the payment to the User if the User has chosen a method of delivery other than the cheapest standard delivery method offered by the Seller.
The Seller will make a refund using the same means of payment used by the User in the initial transaction unless the User has expressly agreed to another means of payment, and the User will not be charged any additional fees for the refund.
The User must send the goods or deliver them to the Seller or to the person authorized by the Seller to receive the goods (whichever is faster) without delay, and in any case, no later than 14 (fourteen) days from the day they sent their decision to unilaterally terminate the Contract to the Seller.
The User bears the direct cost of returning the goods.
The User is responsible for any impairment of the goods resulting from the handling of the goods, except for what was necessary to determine the nature, characteristics, and functionality of the goods.
The User is obliged to provide the goods to the Seller or to the person authorized by the Seller to receive the goods without delay, and in any case, no later than 14 (fourteen) days from the day they sent their decision to unilaterally terminate the Contract to the Seller.
The Buyer must return the goods to the Seller or to the person authorized by the Seller to receive the goods without delay, and in any case, no later than 14 (fourteen) days from the day they sent their decision to unilaterally terminate the Contract to the Seller.
The Buyer will return the goods by mail, or deliver them to the Seller or to the person authorized by the Seller to receive the goods, and FRANJA TRGOVAČKI OBRT, owned by Jaki Franja, will bear the cost of returning the goods.
If the Buyer unilaterally terminates the Contract, they are obliged to compensate the Seller for any reduction in the value of the goods resulting from the use of the goods that goes beyond what is necessary to determine the nature, characteristics, and functionality of the goods.
The Seller is entitled to unilaterally terminate the Contract if, due to a typographical error or incorrect stock status on the website, the User was able to purchase the item at an obviously incorrect price.
The User agrees that in this case, the Seller will contact them with an appropriate explanation of the error, with a request for consent to purchase the item at the correct price or the cancellation of the Contract, and the User will have the right to cancel the Contract at their discretion.
Termination of the Contract by the Seller due to a typographical error or incorrect stock status on the website does not affect the right to unilateral termination of the Contract.

Payment Card Security Statement
Security of your transaction and your personal data is a priority for us. When buying, you are transferred to the WSPay Payment Gateway for processing payment. WSPay is a system for secure payment, real-time payment, credit, and debit cards, and other payment methods.
The WSPay Payment Gateway uses state-of-the-art data protection standards – Secure Socket Layer (SSL) protocol with 256-bit encryption and the MD5 algorithm.
The ISO 8583 protocol ensures that data exchange between the T-Com System and the credit card authorization centers takes place on a private network, which is protected from unauthorized access by a double layer of firewalls.
The WSPay Payment Gateway and financial institutions exchange data through a virtual private network (VPN), which is protected from unauthorized access.
Confidential information from the buyer’s credit card is only transmitted encrypted over the Internet. Payment card information is not available to our system.
This system meets all the requirements for secure online payment prescribed by the leading credit card brands, i.e., operates in accordance with the requirements of the PCI DSS Level 1 standard – the highest standard of the payment card industry.
Security controls and the ability to trace and audit the security of stored cardholder data were conducted by an external auditor and the company that stores and processes payment card data is certified according to PCI DSS Level 1 standard.
The result of this review is a report on compliance (Report on Compliance) which is issued by an external auditor and confirms that the Seller’s online store meets the requirements of the PCI DSS Level 1 standard.
The seller does not store the credit card number or the CCV code (the last three numbers on the back of the credit card), and the WSPay Payment Gateway encrypts this data during entry.
Payment System
The WSPay Payment Gateway for Internet payments uses the most modern standards in protecting the entry and transfer of confidential data, including the SSL protocol and the 256-bit encryption key. The ISO 8583 protocol ensures that data exchange between the WSPay Payment Gateway and the authorization centers of credit card companies takes place in a private network, which is protected from unauthorized access by a double layer of firewalls.
WSPay uses a 256-bit SSL certificate as the highest level of data protection. Confidential data from your credit card is sent directly to the bank’s authorization system. The payment card information is not available to our system.
Fraud Detection
When entering payment card data, confidential information is transmitted over a public network in a secure (encrypted) form using SSL protocols and PKI systems, as currently the most modern cryptographic technology. Data security during the purchase is guaranteed by the payment card processor, WSPay, so the complete billing process is performed on the WSPay Payment Gateway pages. At no point in time is the payment card information available to our system.
Dispute Resolution
In the event of a dispute between the Buyer and the Seller regarding the payment of goods and services, the Buyer may contact the Seller through the email address or phone number provided on the Seller’s website to resolve the dispute.
If a resolution cannot be reached through negotiation, the Buyer and the Seller agree to submit the dispute to the competent court in Zagreb, with the application of Croatian law.
